PaciTime Terms of Service

These Terms of Service ("Terms") govern your access to and use of PaciTime, available at pacitime.snugglesmp.com, including its dashboard, Twitch integrations, timers, stream overlays, team features, and related services (collectively, the "Service").

PaciTime is operated by Cloud Data Hosting LLC, a Minnesota company ("Cloud Data Hosting," "we," "us," or "our").

By accessing, authenticating with, or using PaciTime, you agree to these Terms. If you do not agree, do not use the Service.

1. About PaciTime

PaciTime is a web-based Twitch streaming utility that allows eligible Twitch streamers to operate a customizable countdown timer and stream overlay.

Depending on the streamer's configuration, the timer may be triggered or extended by supported Twitch events, including:

PaciTime also provides a settings dashboard, activity information, customizable overlay appearance, and optional team-access functionality.

PaciTime is currently provided free of charge.

PaciTime is an independent service and is not affiliated with, endorsed by, sponsored by, or operated by Twitch Interactive, Inc.

2. Eligibility

You must be at least 18 years old to use PaciTime.

By accessing or using the Service, you represent that:

  1. you are at least 18 years old;
  2. you have the legal capacity to enter into these Terms;
  3. your use of PaciTime is lawful where you reside; and
  4. you are authorized to use the Twitch account with which you authenticate.

PaciTime is not directed to children or persons under 18.

If we learn that a person under 18 is using the Service, we may immediately suspend access and delete associated information as appropriate.

3. Twitch Authentication

PaciTime uses Twitch OAuth as its authentication system.

PaciTime does not maintain a separate username/password authentication system.

When connecting your Twitch account, PaciTime requests certain Twitch permissions necessary to provide its functionality. These may currently include permissions relating to:

You are responsible for reviewing the permissions displayed by Twitch before authorizing PaciTime.

You may revoke PaciTime's Twitch authorization through your Twitch account settings.

Revoking authorization may cause some or all PaciTime functionality to stop working.

4. Twitch Terms

Your use of Twitch remains subject to Twitch's own terms, policies, Community Guidelines, Developer requirements, and other applicable rules.

You may not use PaciTime to circumvent Twitch restrictions, interfere with Twitch services, or engage in conduct prohibited by Twitch.

Changes made by Twitch to its APIs, EventSub system, OAuth system, policies, functionality, or availability may affect PaciTime without notice.

We are not responsible for interruptions or loss of functionality resulting from Twitch or other systems outside our reasonable control.

5. Your Timer and Overlay

PaciTime provides users with a customizable stream timer and overlay.

You are responsible for configuring and using your overlay appropriately.

Available customization may include features such as:

You are responsible for any text, image URL, configuration, or other material you provide to the Service.

6. Overlay URLs and Access Credentials

PaciTime may generate URLs, keys, tokens, session credentials, or similar information used to access private or user-specific functionality.

You are responsible for keeping such information confidential where appropriate.

In particular, you should take care not to unintentionally expose private overlay keys or URLs through:

If you believe an access credential or overlay key has been compromised, contact us.

We may invalidate, rotate, replace, or otherwise modify access credentials when reasonably necessary for security or operation of the Service.

7. Team Access

PaciTime may allow account owners to invite other Twitch users to assist with managing their PaciTime configuration.

Team members may be assigned roles such as viewer, moderator, administrator, or other roles offered by the Service.

The account owner is responsible for:

PaciTime may maintain administrative action logs to provide accountability for changes made by team members.

8. Acceptable Use

You may not use PaciTime to:

Good-faith security research should be reported privately rather than exploited or publicly disclosed before we have a reasonable opportunity to investigate.

9. User-Provided Content

You retain ownership of content you provide to PaciTime.

You grant Cloud Data Hosting LLC a limited, non-exclusive license to process, store, reproduce, and display that content solely as reasonably necessary to operate, secure, maintain, and provide the Service.

For example, if you provide a custom overlay title or background-image URL, PaciTime must process that information to display your configured overlay.

You represent that you have the necessary rights to use content you provide through PaciTime.

10. Twitch Events and Viewer Information

PaciTime receives certain events from Twitch in order to provide timer functionality.

These events may include information concerning Channel Points redemptions, Bits, subscriptions, resubscriptions, gifted subscriptions, and raids.

The Service may record the Twitch login/display name associated with an event, the relevant event amount or type, and the time the event occurred.

This information may appear in the streamer's PaciTime activity feed.

Use of PaciTime does not give a streamer ownership of Twitch's underlying data.

11. Service Availability

We try to keep PaciTime operational, but continuous availability is not guaranteed.

The Service may be unavailable because of:

We may modify, suspend, restrict, or discontinue all or part of PaciTime at any time.

12. Changes to Features

PaciTime is actively developed.

Features, interfaces, integrations, limits, requirements, and functionality may change over time.

We may add, remove, modify, or replace features without guaranteeing continued availability of any particular functionality.

13. Current and Future Pricing

PaciTime is currently provided free of charge.

We reserve the right to introduce optional paid functionality, premium features, subscriptions, or other monetization in the future.

We will not retroactively charge you for previously free use.

If a paid service is introduced, applicable pricing and payment terms will be disclosed before you purchase or subscribe to it.

14. Suspension and Termination

We may suspend, restrict, or terminate access to PaciTime if we reasonably believe that:

You may stop using PaciTime at any time.

15. Account and Data Deletion

PaciTime does not currently provide a self-service account deletion feature.

You may request deletion of your PaciTime account and associated personal information by contacting us.

Revoking Twitch authorization does not necessarily delete information already stored by PaciTime.

16. Intellectual Property

PaciTime's software, branding, design, graphics, documentation, and other materials provided by Cloud Data Hosting LLC are owned by Cloud Data Hosting LLC or their respective licensors and are protected by applicable intellectual-property laws.

These Terms do not transfer ownership of PaciTime or its intellectual property to you.

Twitch and related Twitch names, marks, and services belong to their respective owners.

17. Feedback

If you voluntarily provide suggestions, ideas, or feedback concerning PaciTime, you permit us to use that feedback to improve or develop the Service without compensation or obligation to you.

This does not transfer ownership of unrelated intellectual property or content you provide through the Service.

18. Disclaimer of Warranties

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, PACITIME IS PROVIDED "AS IS" AND "AS AVAILABLE."

CLOUD DATA HOSTING LLC MAKES NO WARRANTY, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AVAILABILITY, RELIABILITY, ACCURACY, OR ERROR-FREE OPERATION.

WE DO NOT GUARANTEE THAT:

You use PaciTime at your own risk.

19. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, CLOUD DATA HOSTING LLC AND ITS OWNERS, MEMBERS, OFFICERS, EMPLOYEES, CONTRACTORS, VOLUNTEERS, AND AGENTS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING FROM OR RELATING TO PACITIME.

THIS INCLUDES, WITHOUT LIMITATION:

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR AGGREGATE LIABILITY ARISING FROM OR RELATING TO THE FREE SERVICE WILL NOT EXCEED US $100.

Some jurisdictions do not permit certain limitations of liability, so portions of this section may not apply to you.

20. Indemnification

To the extent permitted by applicable law, you agree to defend, indemnify, and hold harmless Cloud Data Hosting LLC and its owners, officers, employees, contractors, and agents from claims, damages, liabilities, losses, and reasonable expenses arising from your unlawful use of PaciTime, your violation of these Terms, or content you provide through the Service.

21. Governing Law

These Terms are governed by the laws of the State of Minnesota, United States, without regard to conflict-of-law principles.

To the extent permitted by applicable law, disputes arising from these Terms or PaciTime will be brought in a court of competent jurisdiction located in Minnesota.

Nothing in this section deprives a consumer of mandatory protections that cannot lawfully be waived in their jurisdiction.

22. Changes to These Terms

We may update these Terms as PaciTime changes or as necessary for legal, operational, security, or regulatory reasons.

The updated version will be published through PaciTime with a revised "Last Updated" date.

For material changes, we may provide additional notice where reasonably appropriate.

Continued use of PaciTime after updated Terms become effective constitutes acceptance to the extent permitted by applicable law.

23. Severability

If a provision of these Terms is determined to be invalid or unenforceable, the remaining provisions will remain in effect to the extent permitted by law.

24. No Waiver

Failure to enforce a provision of these Terms does not waive our right to enforce it later.

25. Entire Agreement

These Terms, together with the PaciTime Privacy Policy and any additional policies expressly incorporated into them, constitute the agreement between you and Cloud Data Hosting LLC concerning your use of PaciTime.
